Upon review of the correspondence between the Village of Menands and Fusion Recovery, there are serious points of contention and lack of mutual understanding that can’t be disregarded.

Here is my analysis of the situation and an unequivocal proposal for our next steps:

  1. Address the Discrepancies: The initial step is to tackle the discrepancies between the claims of both parties. The Village of Menands asserts Fusion Recovery incorrectly understood the nature of permits and support letters from local authorities. On the contrary, Fusion Recovery argues they’ve adhered to due process as stipulated by the New York Office of Addiction Services and Supports (OASAS).
  2. Demand an Independent Audit or Investigation: The complexity of this issue, coupled with serious allegations from both parties, necessitates an independent third-party audit or investigation into Fusion Recovery’s application and approval process. This step is crucial in ascertaining whether Fusion Recovery and associated local and state agencies complied with all legalities and procedures.
  3. Prioritize the Local Community: The concerns expressed by the Village of Menands, representing the local community, must be a primary consideration. Fusion Recovery should not be given any room to placate or sidestep these concerns under the guise of a community outreach program.
  4. Seek Legal Counsel: With the significant legal implications this situation entails, seeking professional legal counsel should be an immediate action. Legal experts can guide us on potential legal paths to take and help navigate this convoluted issue.
  5. Maintain Transparent Communication: Our stance demands full transparency and regular updates between all parties involved. This can help ensure misconceptions are eradicated, mutual understanding is achieved, and trust is built within our community. We should be promptly updated on the progress of the audit, Fusion Recovery’s attempts to address our concerns, and any changes in the project’s status.

I believe that the actions I have outlined are necessary to protect the interests of the Village of Menands and its residents. I urge the Village board to take action immediately.
