Our ongoing struggle against the proposed Opioid Treatment Program (OTP) in the Broadway Business District is intensifying. Contrary to the village’s misguided advice to the landlord at 444 Broadway, an OTP is not a use “Permitted by Right” within this district. This is in direct conflict with the zoning code that clearly states a “Business & Professional Office” cannot offer on-site patient care. Our appeal was unfortunately dismissed due to the 60-day rule—a mere technicality that overlooks the substantive issues at hand. This disheartening setback accentuates the need for unyielding advocacy.

The Village attorney suggests that filing an Article 78 lawsuit is our next step if we disagree with the zoning decision. This is a grim prospect—suing the very community we belong to. Why should it come to this when the board has the prerogative and duty to correct this glaring error?
